These Terms and Conditions (“Terms”) govern your access to and use of the Terminal Three website, your purchase of products from us, and any other interaction you have with Terminal Three through our website or related digital platforms.
By accessing our website, creating an account, placing an order or otherwise using our services, you agree to be bound by these Terms.
Please read them carefully before using our website or placing an order.
Nothing in these Terms is intended to limit or exclude any rights available to you under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), the Protection of Personal Information Act 4 of 2013 (“POPIA”), or any other applicable law.

2. USE OF OUR WEBSITE
You may use our website only for lawful purposes.
You agree that you will not:
- use the website in a way that violates applicable law;
- attempt to gain unauthorised access to the website or related systems;
- interfere with the operation, security or performance of the website;
- introduce viruses, malicious code or other harmful technology;
- use automated tools to scrape, copy or harvest information without our permission;
- impersonate another person;
- provide false or misleading information;
- use the website for fraudulent activity;
- attempt to circumvent security or payment systems;
- reproduce or commercially exploit our website content without authorisation; or
- use our website in a manner that may cause damage to Terminal Three, our customers or third parties.
We reserve the right to restrict or suspend access to the website where reasonably necessary for security, maintenance, fraud prevention or legal compliance.
3. ELIGIBILITY TO PURCHASE
By placing an order, you confirm that:
- you have legal capacity to enter into the transaction; or
- where required, you have the consent or assistance of a parent, guardian or other legally authorised person.
You are responsible for ensuring that the information provided during checkout is complete and accurate.
4. CUSTOMER ACCOUNTS
Where account functionality is available, you may choose to create a Terminal Three customer account.
You are responsible for:
- keeping your account details accurate;
- keeping your password and login credentials confidential;
- restricting unauthorised access to your account; and
- notifying us if you become aware of suspicious or unauthorised activity.
You must not share your account credentials with another person where doing so creates a security risk.
Terminal Three may suspend or deactivate an account where there are reasonable grounds to suspect fraud, abuse, unauthorised activity or breach of these Terms.
You may also purchase products as a guest where guest checkout is available.
5. PRODUCT INFORMATION
We aim to provide accurate descriptions, photographs, dimensions, colours, materials and other product information.
However:
- colours may appear differently depending on your device, screen settings or lighting;
- minor variations may occur between individual products;
- measurements may be subject to reasonable manufacturing tolerances; and
- product packaging or minor design details may change from time to time.
Such minor variations do not necessarily constitute a defect.
We will, however, honour all rights available to you under applicable consumer law where goods are defective, unsafe, materially different from their description or otherwise fail to meet statutory standards.
6. PRODUCT AVAILABILITY
All products are subject to availability.
We take reasonable steps to ensure that stock availability shown on our website is accurate, but stock discrepancies may occasionally occur.
If a product becomes unavailable after you place an order, we may:
- notify you as soon as reasonably possible;
- offer an alternative where appropriate and with your agreement; or
- cancel the affected item and refund the amount paid for it.
Where we are unable to fulfil an order due to lack of availability, any refund due will be processed in accordance with applicable law.
7. PRICES
All product prices will be displayed on our website.
Unless otherwise stated:
- prices are quoted in South African Rand (ZAR);
- applicable taxes are included where legally required; and
- delivery charges are calculated separately and shown before checkout is completed.
The price payable for a product is generally the price displayed at the time your order is submitted, subject to applicable law.
We take reasonable care to ensure that prices are accurate.
If an obvious pricing, typographical or technical error occurs, we reserve the right, where permitted by law, to correct the error before fulfilling the order.
If payment has already been made and we cannot lawfully or reasonably fulfil the order at the erroneous price, we may cancel the affected item and refund the amount paid.
Nothing in this clause limits any statutory rights you may have regarding displayed prices.
8. PROMOTIONS AND DISCOUNT CODES
From time to time, Terminal Three may offer:
- discount codes;
- promotional pricing;
- free-shipping offers;
- bundle offers;
- launch promotions;
- limited-time campaigns; or
- other special offers.
Unless otherwise stated:
- promotions are available for the stated promotional period only;
- promotions are subject to stock availability;
- discount codes cannot be redeemed for cash;
- discount codes may not be combined unless expressly permitted;
- one discount code may be permitted per order;
- promotional discounts cannot be applied retrospectively;
- minimum-spend requirements may apply;
- certain products or collections may be excluded; and
- promotions may be limited to one redemption per customer.
Specific promotional terms will apply where they are published with the relevant promotion.
Where a customer returns an item purchased as part of a bundle or multi-item promotion, the value of any refund may be recalculated to reflect the terms of the original promotion, subject always to applicable consumer law.
We may amend or withdraw a promotion where reasonably necessary because of errors, fraud, abuse, stock limitations or other legitimate business reasons, provided that we comply with applicable law.
9. PLACING AN ORDER
Products displayed on the website constitute an invitation to customers to submit an order.
When you place an order, you make an offer to purchase the selected products subject to these Terms.
Before submitting your order, the checkout process will provide you with an opportunity to review your order information and correct relevant errors.
ECTA requires online suppliers to give consumers the opportunity to review a transaction, correct mistakes and withdraw before finally placing an order.
After placing an order, you may receive an automated confirmation acknowledging that the order has been received.
An automated order acknowledgement does not necessarily mean that your order has been finally accepted.
Acceptance occurs once:
- your payment has been successfully authorised or received;
- we have verified the order where reasonably necessary; and
- we accept the order for fulfilment.
10. RIGHT TO REFUSE OR CANCEL AN ORDER
We may refuse, suspend or cancel an order where reasonably necessary, including where:
- payment has not been authorised;
- payment appears fraudulent;
- customer information appears inaccurate or incomplete;
- the product is no longer available;
- there is a genuine pricing or website error;
- an order exceeds reasonable quantity limits;
- we suspect resale or commercial misuse contrary to a promotion;
- the transaction breaches these Terms; or
- we are legally required to do so.
If we cancel an order after valid payment has been received, we will refund the applicable amount in accordance with applicable law.
We will not cancel orders arbitrarily where doing so would violate your statutory rights.
11. PAYMENT
Available payment methods will be displayed at checkout.
Payments may be processed by third-party payment service providers.
Depending on the payment method selected, you may be required to provide payment information directly to that provider.
You warrant that:
- you are authorised to use the payment method selected; and
- the payment information you submit is accurate.
We may conduct reasonable fraud-prevention checks before accepting or fulfilling an order.
A transaction may be declined where the payment provider or Terminal Three has reasonable grounds to suspect fraud, unauthorised use or another security concern.
We do not guarantee that every payment method will be available at all times.
12. PAYMENT SECURITY
We use payment systems and service providers intended to meet appropriate security standards for online transactions.
ECTA requires an online supplier to use a payment system sufficiently secure having regard to accepted technological standards and the type of transaction concerned.
While we and our service providers take reasonable security measures, no online system can be guaranteed to be completely secure.
Please refer to our Privacy Policy for further information about how payment-related and personal information is handled.
13. DELIVERY
We deliver orders in accordance with our Shipping Policy.
During checkout, you must provide a complete and accurate delivery address and contact details.
You are responsible for ensuring that:
- the address is correct;
- someone can reasonably receive the parcel where required;
- access instructions are accurate; and
- the courier can contact you if necessary.
Estimated delivery periods are estimates unless we expressly state otherwise.
Delays may arise due to circumstances outside our reasonable control, including:
- courier delays;
- severe weather;
- public holidays;
- strikes;
- road closures;
- supply-chain disruption;
- high-volume promotional periods;
- incorrect customer information; or
- other unforeseen circumstances.
We will take reasonable steps to keep customers informed of material delivery delays.
14. DELIVERY TIME UNDER ECTA
Unless another delivery period has been agreed with you, ECTA generally requires an online supplier to execute an order within 30 days after receiving the order.
Where a supplier fails to execute the order within the required or agreed period, the consumer may have statutory cancellation rights.
If goods become unavailable and we cannot perform the agreement, we will notify you and provide any refund required by law.
15. FAILED OR INCORRECT DELIVERY INFORMATION
If delivery cannot be completed because:
- you provided an incorrect or incomplete address;
- you failed to provide required access information;
- repeated delivery attempts were unsuccessful; or
- the parcel is returned to us because of customer-provided information,
we may require payment of an additional delivery fee before dispatching the order again, to the extent permitted by law.
This does not apply where the delivery failure was caused by Terminal Three or our appointed courier.
16. RISK AND OWNERSHIP
Risk of loss or damage to a product generally passes to you when the product is delivered to you or a person authorised by you to receive it.
Ownership of the products passes to you once full payment has been received, subject to applicable law.
Nothing in this clause limits any responsibility that Terminal Three or a courier may have for loss or damage occurring before delivery.
17. INSPECTION OF YOUR ORDER
We recommend checking your order reasonably soon after delivery.
Please contact us promptly if:
- the wrong item was delivered;
- an item is missing;
- a product was damaged in transit; or
- you believe a product is defective.
Providing photographs and your order number may help us assess the issue more efficiently.
Failure to inspect immediately does not remove any statutory rights you may have under applicable consumer law.
18. RETURNS, EXCHANGES AND REFUNDS
Returns, exchanges and refunds are governed by our Returns & Refunds Policy, which forms part of these Terms.
Nothing in our Returns & Refunds Policy or these Terms limits rights you may have under the CPA, ECTA or other applicable consumer legislation.
Where our voluntary Returns & Refunds Policy offers you more favourable rights than the law requires, those additional rights will also apply according to the terms of that policy.
19. ECTA COOLING-OFF PERIOD
Where section 44 of ECTA applies to your transaction, you may cancel an eligible electronic transaction for goods within seven days after receiving the goods, without giving a reason and without penalty.
Where this statutory right applies:
- you may be responsible for the direct cost of returning the goods;
- the goods must be returned in accordance with applicable law; and
- any refund required by ECTA will be made within the period prescribed by law.
ECTA provides for this seven-day cooling-off right for eligible online purchases and limits the consumer’s charge to the direct cost of returning the goods.
Certain categories of transactions are excluded from this cooling-off right under ECTA.
Nothing in our Terms reduces a cooling-off right that legally applies to you.
20. DEFECTIVE GOODS AND THE CONSUMER PROTECTION ACT
Goods supplied by Terminal Three are subject to applicable consumer guarantees under South African law.
Where the CPA applies, consumers have rights in relation to goods that are:
- unsafe;
- defective;
- of unacceptable quality;
- materially inconsistent with their description; or
- not reasonably suitable for the purpose for which they are generally intended.
Where a product is legitimately defective, you may be entitled to the remedy provided by applicable law.
We may reasonably inspect a returned product to establish the nature and cause of the problem.
21. WHAT IS NOT GENERALLY A MANUFACTURING DEFECT
Subject to applicable law, the following will not ordinarily constitute a manufacturing defect:
- ordinary wear and tear;
- accidental damage;
- misuse or abuse;
- damage caused by overloading;
- cuts, tears, burns or abrasion caused after delivery;
- damage caused by improper storage;
- damage caused by failure to follow the supplied care instructions;
- unauthorised alterations;
- damage caused by inappropriate cleaning products or cleaning methods;
- fading or deterioration caused by unreasonable exposure to environmental conditions; or
- damage resulting from use of the product for a purpose for which it was not intended.
This clause does not affect your rights where a genuine defect existed in the product.
22. PRODUCT CARE
Terminal Three products should be used and cared for in accordance with the care instructions supplied with the product.
For Terminal Three bags, customers should refer to the care instructions card supplied with the bag.
Failure to follow care instructions may cause damage that is not attributable to a manufacturing defect.
23. PRODUCT USE
You are responsible for using products reasonably and for their intended purpose.
Terminal Three is not responsible, to the extent permitted by law, for loss or damage caused by:
- intentional misuse;
- negligent use;
- excessive loading;
- failure to follow warnings or instructions;
- unauthorised modification; or
- use outside the product's intended purpose.
24. INTELLECTUAL PROPERTY
All intellectual property displayed or made available through the Terminal Three website belongs to Terminal Three or its applicable licensors.
This includes, without limitation:
- the Terminal Three name;
- logos;
- trademarks;
- product names;
- photographs;
- product designs;
- illustrations;
- graphics;
- videos;
- text;
- website design;
- page layouts;
- packaging concepts;
- marketing materials; and
- other original content.
You may view and use website content for personal, non-commercial shopping and informational purposes.
You may not, without our prior written consent:
- reproduce;
- copy;
- modify;
- republish;
- distribute;
- sell;
- licence;
- scrape;
- commercially exploit; or
- create derivative works from
our intellectual property, except where otherwise permitted by law.
25. TERMINAL THREE TRADEMARKS AND BRANDING
The Terminal Three name, branding and related marks may not be used in a way that:
- implies an affiliation or endorsement that does not exist;
- creates confusion with another business;
- misrepresents Terminal Three products; or
- damages or dilutes our brand rights.
Nothing on our website grants any licence to use our trademarks unless expressly stated.
26. USER-GENERATED CONTENT
If you voluntarily tag Terminal Three, submit photographs, reviews, testimonials or other content to us, you retain your rights in that content.
Where you expressly permit us to repost or use that content, you grant Terminal Three a non-exclusive licence to use it for the purposes agreed with you.
We will not claim ownership over customer photographs merely because you tag our social media account.
Separate promotional or competition terms may apply where content is submitted as part of a campaign.
27. REVIEWS
Customer reviews must reflect genuine experiences and must not:
- contain unlawful material;
- infringe another person's rights;
- contain malicious code;
- impersonate another person;
- contain knowingly false statements; or
- be submitted fraudulently.
We may moderate or remove reviews where reasonably necessary for legal, security or authenticity reasons.
We will not remove legitimate negative reviews solely because they are critical of Terminal Three.
28. THIRD-PARTY LINKS
Our website may contain links to external websites or platforms.
These links are provided for convenience and do not necessarily constitute endorsement.
Terminal Three does not control third-party websites and is not responsible for their content, availability, security or privacy practices.
You use third-party websites at your own discretion and subject to their own terms.
29. WEBSITE AVAILABILITY
We aim to keep our website available and functional, but we do not guarantee uninterrupted access.
The website may be unavailable temporarily because of:
- maintenance;
- updates;
- technical faults;
- hosting issues;
- security incidents;
- internet outages; or
- circumstances outside our reasonable control.
We may modify, maintain, suspend or discontinue parts of the website where reasonably necessary.
30. WEBSITE SECURITY
You must not attempt to:
- gain unauthorised access to our servers or systems;
- interfere with website functionality;
- upload malicious code;
- intercept information;
- conduct denial-of-service attacks; or
- compromise the security of the website.
We reserve the right to take appropriate technical or legal action where unlawful or harmful activity is detected.
31. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
Subject to that qualification and to the extent permitted by law, Terminal Three will not be liable for indirect, incidental, special or consequential loss resulting from:
- misuse of a product;
- unauthorised use of your account;
- third-party websites;
- events outside our reasonable control;
- delays caused solely by third parties; or
- use of the website contrary to these Terms.
Any limitation of liability in these Terms must be interpreted consistently with the CPA and other applicable consumer-protection legislation.
32. EVENTS BEYOND OUR REASONABLE CONTROL
Terminal Three will not be responsible for delay or failure caused by circumstances reasonably beyond our control, including:
- natural disasters;
- severe weather;
- fire;
- flood;
- war;
- civil unrest;
- epidemic or pandemic restrictions;
- national infrastructure failure;
- strikes;
- widespread telecommunications outages;
- government restrictions;
- port or transport disruption;
- supplier interruption; or
- courier network disruption.
We will take reasonable steps to mitigate the effect of such events.
33. FRAUD
We reserve the right to investigate transactions we reasonably suspect to be fraudulent.
We may:
- request additional verification;
- temporarily place an order on hold;
- refuse payment;
- cancel an order;
- block abusive accounts; or
- report suspected unlawful conduct to appropriate authorities,
where reasonably necessary and legally permissible.
34. RESELLING AND COMMERCIAL PURCHASES
Unless otherwise agreed in writing, products sold through our consumer website are intended for personal use.
We may limit quantities or reject orders where we reasonably believe an order is intended for unauthorised resale, bulk commercial distribution or abuse of promotional offers.
For wholesale or commercial enquiries, please contact us directly.
35. GIVEAWAYS AND COMPETITIONS
Terminal Three may occasionally run competitions or giveaways.
Each competition may have its own specific terms.
Unless otherwise stated:
- entrants must meet the eligibility criteria specified in the promotion;
- entries received after the closing time will not be valid;
- prizes cannot be exchanged for cash;
- prizes are subject to availability;
- winners may be required to respond within a specified period;
- we may verify eligibility before awarding the prize;
- fraudulent entries may be disqualified; and
- additional promotional terms may apply.
Where required, we will obtain appropriate permission before using a winner's personal information for marketing purposes.
36. PRIVACY
We collect and process personal information in accordance with our Privacy Policy and applicable data-protection legislation.
By using the website, you acknowledge that personal information may be processed for purposes including:
- order fulfilment;
- payment;
- delivery;
- customer service;
- fraud prevention;
- legal compliance; and
- marketing where legally permitted.
Please refer to our Privacy Policy for complete details.
37. ELECTRONIC COMMUNICATION
By using our website or communicating with us electronically, you consent to receiving transactional communications electronically where appropriate.
These may include:
- order confirmations;
- payment notifications;
- delivery updates;
- customer-service messages;
- return and refund communications;
- account notifications; and
- legally required notices.
Marketing communications will be sent only where permitted by applicable law, and you may opt out as described in our Privacy Policy.
38. RECORDS OF TRANSACTIONS
We may retain electronic records relating to orders and transactions for accounting, tax, legal, fraud-prevention and customer-service purposes.
ECTA requires online suppliers to disclose how and for what period customers may access and maintain a full record of electronic transactions.
Customers may retain their order confirmation and related emails as a record of the transaction, and where customer-account functionality permits, transaction information may also be accessible through the customer's account.
39. COMPLAINTS AND CUSTOMER SERVICE
If you experience a problem with an order or our service, please contact us at:
Email: admin@terminalthree.co.za
Please provide:
- your name;
- order number;
- a description of the issue; and
- any relevant photographs or supporting information.
We will take reasonable steps to investigate and resolve legitimate complaints.
40. DISPUTE RESOLUTION
We encourage customers to contact us first so that we can attempt to resolve disputes directly and reasonably.
Nothing in these Terms prevents a consumer from exercising any right to approach:
- a competent court;
- the National Consumer Commission;
- a consumer ombud with jurisdiction;
- the Consumer Goods and Services Ombud, where applicable;
- the Information Regulator in relation to data protection; or
- any other appropriate regulatory or dispute-resolution body.
Nothing in these Terms requires you to waive a statutory right to pursue a remedy through a competent forum.
41. GOVERNING LAW
These Terms and any transaction concluded through the Terminal Three website are governed by the laws of the Republic of South Africa, subject to any mandatory rights that may apply to a customer under another applicable law.
South African courts will have jurisdiction over disputes, subject to applicable consumer legislation and any other legally available dispute-resolution process.
42. CHANGES TO THESE TERMS
We may amend these Terms from time to time to reflect:
- changes in our business;
- new products or services;
- changes in our website;
- changes in applicable law;
- changes in our service providers; or
- operational requirements.
The latest version will be published on our website with an updated revision date.
Changes will generally apply prospectively and will not remove rights that already accrued to you under a completed transaction.
43. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as severable to the extent necessary.
The remaining provisions will continue to apply.
44. NO WAIVER
If Terminal Three does not immediately enforce a provision of these Terms, that does not mean we have waived the right to enforce that provision later.
Any waiver must be clear and, where appropriate, recorded in writing.
45. ENTIRE AGREEMENT
These Terms, together with our:
- Privacy Policy;
- Shipping Policy;
- Returns & Refunds Policy;
- product-specific terms; and
- any applicable promotional terms,
constitute the agreement governing purchases made through our website.
Where there is a conflict between these Terms and specific promotional or product terms, the more specific terms will apply to that transaction, subject to applicable law.
46. CONSUMER RIGHTS
Nothing in these Terms is intended to:
- waive;
- exclude;
- restrict; or
- limit
any consumer right that may not lawfully be waived, excluded, restricted or limited under South African law.
If any provision of these Terms conflicts with a mandatory provision of applicable consumer law, the mandatory legal provision will prevail.
